HIS Advocates General Warranty Deed

Disclaimer: The purpose of this process is to transfer your registered home, which is currently held in legal title using a legal description (above the land), out of the public and into the private by conveying the home properly.

The Deed should be conveyed to your private Foundation that HIS Advocates, s.s.m. creates for you, using a lawful form of money, with proper vesting, with proper land description (Plot or meets & bounds), and with an acceptance of the Deed on the face of the deed.

We provide you with a General Warranty Deed which is designed to be recorded into your County where the property/land sits.

I/We understand that my/our County may not accept HIS Advocates ‘General Warranty Deed’ format and may require me/us to use their format or accepted template and may also require me/us to fill out accompany other forms as required. Note: Prior to recording your instrument(s), please post a copy with your questions to hisadvocates.org member support ticket.

I/We understand that I may have to take the language out of what HIS Advocates creates for me/us and put it the required new format/template accepted by my/our County and that HIS Advocates will not be responsible for making said changes to the new format.

I/We understand that even with a proper format, HIS Advocates does not guarantee that your County will record the instrument as is or at all due to any encumbrance issues already noted on your original (current deed) not brought forth to the new deed or other reasons not mentioned.

I/We understand that when transferring the Deed (Grant, Warranty, Quitclaim, etc.) that a ‘transfer fee’ may be assessed and required to record the documents. In such cases, completion of a ‘property assessment’ form (or similar form) and payment of the fee may be required to facilitate the transfer and recordation of your new Deed or otherwise be declined if form and fee is not provided. It is HIS Advocates position that such a form is required for individuals and corporations of which your Private Foundation (Church/Ministry) is neither. Please note that completing a tax form or paying a transfer fee does NOT in itself grant the County jurisdiction over you or the Private Foundation (Church/Ministry).

I/We understand that if our new Deed is not successfully filed in the County recorder, that future property taxes may be assessed to the owner on record (SELLER) and if such property taxes are not paid from the owner on record, this could result in liens, levy, forfeiture, and/or foreclosure of the property.

I/We understand that HIS Advocates cannot guarantee that after successfully recording the new Deed, that my/our County (or jurisdiction) will not later initiate some form of action against me/us personally or potentially, my/our foundation, ministry, or trust.

1. Is the property free and clear of any debt or encumbrances?

5. Exhibit C: Does your property have any restrictions or covenants? For example, a restriction or covenant can be an easement, dedicated wildlife preservation, wetlands, etc.
